Domestic problems

Last year my wife (now ex) land I had a fight. She called the police and told them I was beating her which was not true. They came and of course I was arrested. I am still having problems over this issue. My question is this. On the ticket that the police gave me for this so called domestice abuse, it was dated wrong. It was dated January 5,2005 when in fact it should have been dated January 5, 2006. Can I get this thrown out of court on this reason?

No, they will have the opportunity to correct the error if you are not really careful.

That's not an uncommon error, especially in January. If you have been charged with DV abuse, you really need to lawyer up. This is not an issue for an amateur, no matter what you do and how well you know the issues. You are elgible for a public defender if you meet (very generous) income guidelines. If you hate your public defender, fire them and they have to get you a new one. Seriously.

DV abuse charges will follow you all the days of your life and you can never have a gun, not even a shotgun ever again and the charge cannot ever be elgible for vacation.

So please, don't hang your entire defense on the cop getting the date wrong.
