Emancipation

I know of a boy who is being emotionally abused and neglected by his mom who has full custody. She also has a daughter but treats the daughter great and treats the boy terrible and does not support him at all. He is a good student, a great athlete, great kid and does not do drugs and has never been in trouble with the law. He no longer wants to live with his mom and has a family willing to take him in and help him financially. His dad lives in another state and keeps the boy during holidays and during the summer and is all for this happening. Can the boy be emanicipated from his mom? Also mom is threatening to have him sent to juvy for no reason. Can she do this just because she wants to if he is a good kid? He has left home and does not want to go back. He has spoken to mom and told her this and dad knows where he is as well. Can she call the cops and say he is a run away when she has spoken to him and the dad, knows he is ok and where he is?

Without knowing the age of the child and whether he is actually capable of living on his own I don't know if he can be emancipated. His being a runaway would justify calling the police and reporting him as a runaway. Mother talking to him on the phone does not resolve the runaway issue. If the child is being abused and neglected and you know about it, why have you not called CPS?
