Emotional damage vs. Academics
I held my son back in 2nd grade because I was ignorant in the learning process. He is now 12 and all his friends are a grade ahead of him. He is emotionally distraught STILL from being held back. His grades are the top of his class and he tests at a 7th grade reading level. We are petioning the school to let him skip a grade. We are paying for tutoring and anything we can do to get him where he socially and emotionally belongs. What legal rights do we have? We have ti help him move up he is so depressed.

You don't explain who is thwarting your plan to return him to his correct grade level.
The school is the place to start. If the principal won't agree, you have a right to have that decision reviewed administratively.
This is not to suggest you don't have legal rights, just that there is a protocol you have to go through to get this matter heard.
Start with the school. Tell them what is going on and describe how this action you propose will be in your child's best interests.

I have a child who skipped grades. Its just a matter of finding out the process and rules, filling out the paperwork and keeping up with it. Good luck, it will eventually go your way.
