Legal Question in Family Law in Washington
Equity already given-can he get more
My divorce was final in January 2006. My ex-husband got equity out of the home we had at that time and he signed a quit claim on the deed for the house. I am now selling the house for much more than what than what we said the equity was a year and a half ago and he wants what is remaining? Is that possible?

No. I mean it is possibly araguable, but the bottom line is no.
The Washington real estate market has been on a marked upswing for the last several years.
He agreed to take his share in January 2006 - he did not stipulate that in the event the house became worth more at a later date that he could dip in for an additional share.
Sounds as though it was an agreed resolution. Did the matter get appealed possibly?
If I were advising him, I'd say to let go of the injustice and move on.
As you approached and asked, I'd say you don't have to argue this with him any more.
If he brings a motion to the trial court to set aside the agreement or for an additional award, for heaven's sake lawyer up.
But with decent counsel you will be fine. Hope this helps. Elizabeth Powell
