Equity of the home

I moved out 3 years ago of our family

homeI filed for divorce there has been

ongoing paperwork back and forth to

each other-but no paperwork was ever

signed from a judge. my question is--

we recently sold the family home-my

husband said sence he has been paying

the mortgage for the last 3 years he's

entitled to the majority of the equity.the

equity is 95,000 and he wants to only

give me 20,000. He said because in the

last 3 years the property values have

gone up so much. What am I entitled to?

A fair and equitable distribution of all property and debt. The house does not stand alone, and must be considered in the context of all property and debt as well as the relative financial strength of the parties, and contribution of separate property. Fair and equitable does not necessarlily mean 50/50.
