Legal Question in Family Law in Washington
family law
My son is having papers served on his spouse who left the state. We are hiring a process server. What if she evades service? How can we request to use service by certified mail? Must ask the judge?

Have you thought about calling her and asking her to accept service of the process? Don't look for trouble, and chances are it won't find you.
On the principle that the simplest solution is oftentimes the best, you might just try asking.
If she evades service, the process server can file an affidavit regarding attempts to serve and the Court may allow service by publication.
But if you know her address, a PI can get her phone number, and you can call her.

You will have to file a motion to have service by mail authorized. You should state the attempts to effect personal service in the motion. The forms are available on the Washington Courts website.
