I am going through a split up with my son's mother and we have a court date (1st one) concerning a parenting plan, what kind of evidence do I need to produce to show that I have been the provider parent in my son''s behalf?

Begin by reviewing two statutes: the first is RCW 26.09.187(3) found at http://apps.leg.wa.gov/RCW/default.aspx?cite=26.09.187. The second is the definition of "parenting functions" at RCW 26.09.004(3) at http://apps.leg.wa.gov/RCW/default.aspx?cite=26.09.004.

Ask yourself the questions: What facts prove what I want to show to meet these standards? Who has persona; knowledge (from personal observation) of these facts?

The law gives you what needs to be proved, and the answer to those questions will give you your evidence and the witnesses who can present it to the court.

You should do the declaration in support of temporary parenting plan. If there are other people who know that you have been the primary care provider you should have them do declarations to there knowledge of your involvement. More weight will be given to the testimony of professionals or neutral persons than will be given to you or your family, that is not say you should not use their testimony, just remember they are going to be assumed to be on your side and that they will frame their testimony to put you in the best light.
