Fighting over School districts
In our parenting plan it states ''The Respondent by his signature below acknowledges the Petitioner's intenet to relocate to Rochester Washington in the immediate future. Both parties stipulate & agree that this relocation shall not result in a change of daycare provider or school until the Fall of 2006. The parties stipulate & agree that in the Fall of 2006 the children's daycare provider & school district will change. The parties stipulate & agree to abide by the dispute resolution process provider for herein as to the issue of the new daycare provider in the event the parties are not able to reach agreement. The Respondent by his signature below specifically waives any & all objection to this relocation.'' He is threatning me that I can be punished by contempt of court for changing our daughters school this year. The childrens daycare provider is his sister, whom he lives with. It is a 40 minute drive one way & he expects me to drive there everyday. I did last year for about 4 monthes so that she could finish school. Can he doing anything to me? Should I be worried? Some of the language you quoted does not make sense, and I wonder if you misquoted it, or if it is the actual language of the parenting plan. From reading the excerpt from the parenting plan that you have provided, I would say you would appear to be protected from a contempt citation on the basis of relocation. That is not to say that he would not get a hearing on a motion to show cause re contempt, but I don't think he would have much prospect of prevailing. There are limitations on relocation, but it appears that he has waived that issue on this relocation.
