Foster Parent Third Party Custody of Teen

My 13 year old foster son has lived here 11 months with his 5 year old sister. His dad in Michigan passed his home study, but never talks to the boy. He told him he could stay here if he wanted to, but in court the lawyer says he wants him and they plan to send him there by the end of Jan. The boy wants to stay here with his 5 year old sister. We would like to keep them both permenantly. He lived with us when he was 10, the first time he was removed from his Mom. The social worker sugested that we file for third party custody, she said the Mom would support it. Can we do that as foster parents?

Based on this information, you likely would be found to have standing to file a third party custody action. You have been the de facto parent for this child for at least two years. He is doing well with you. The social worker supports this decision.

You will do better with an attorney than you will do on your own. I wish you all the best with this.
