grandparents custody

My brother and his wife have raised their grandaughter since she was 2 months she is now 11 years old, and now the mother wants her back. she has a bad crimenal history of drugs, armed robbery. what is the chances of her getting her back?

It is unclear whether this is a WA case or a CA case. Where do the children live, if in WA then the action is to file a Non-Parental Custody action. As to what the chances are, I don't know based on the facts provided, but the state of WA does try to get biological families back together. History can be yesterday or it could be many years ago or somewhere in between. The longer ago it is the less significant it will be. History can be one documented crime or many, how many and how serious will make a difference. The fact that the child has lived with the grandparents for over 10 years is significant, but they should not wait to see what happens; default, without some form of state intervention, is the child goes to the biological parent(s).
