Grounds for refusing visitation

My ex-husband has court-ordered visitation. I am the custodial parent. His fiancee phoned me in January and said that she had put him out and that he was stalking and harrassing her and her children. Since then, my ex-husband has refused to tell me where he lives and where he will conduct visitation with our 13 year old son. He has phoned, infrequently, from Washington, Idaho and Oregon. I have refused to send our son until I know where he will be. I did permit my son to go to him over Father's Day weekend once I knew that it would held at my son's grandparents' home. I simply need to know where my son will be. Am I in contempt of court?

Whether you former spouse would be successful in a motion for contempt against you would depend on what the parenting plan says and what you are doing. If he is not in compliance with the parenting plan he may be vulnerable on contempt himself. I would encourage you to consider filing a petition to modify the parenting plan to bring the plan into conformity with current conditions rather than wait to see what happens.
