Legal Question in Family Law in Washington

Guardian Ad Litem

Back in January (for a modification of custody case) a Guardian Ad Litem was assigned our case. The GAL has done the interviews, and such. The due date for the report to have been turned into the courts was a month ago! Everytime I contact the GAL, this person claims to be off doing things with friends, kids, and family things...it is almost like this case is not important to them! How long should I allow this to go on before I contact the courts? I feel that the decision has been made but the GAL is just putting us off. The GAL hasn't even contacted our references yet!

Re: Guardian Ad Litem

Tread gently because if you make the GAL angry the GAL is less likely to think you are the best placement resource for the kids.

If you are pro se you should not be contacting the GAL without telling the other side what you are doing.

If you have a lawyer they should be running interference for you.

If the GAL doesn't file their report on time the Court is going to be upset with the GAL and nothing you can say or do is going to make that situation better or worse.

You can write to the GAL, give them your contacts information again, and ask if there is anything else you can do to be helpful.

Send a copy to the other side, and a copy to the court file (with a coversheet).

Believe me that will make your point.

Hope this helps. Elizabeth Powell
