Guardianship of Step-Son

My husband is currently incarcerated. His 17 month old son was removed from his mother's home and placed in his Aunt's home, which is my husband's sister. His case has been sent out to guardianship and his my step sons aunt and I have both filed for guardianship, which the mother is opposed to me getting. Is there anything that will disallow me, as the baby's step-mother from getting guardianship. I currently have guardianship of another child, I have had him for 19 months now.

this case is in Tribal Court as well.

Although I am not going to answer your question, I will make a suggestion that may increase your prospects of getting an answer, if you are doing this action under guardianship (and not 3d Party Custody/Non-Parental Custody) you may want to resubmit this under Native American Law and under Probate (Guardianship is a probate matter).
