Legal Question in Family Law in Washington
I havn't persued visitation for a year and 1 1/2
I have a bad criminal history and domestic violence marks against me and haven't seen my children in a year and a half. The criminal history one of them sexual (communication w/ a minor for an immoral purpose) that was 11 years ago. I'm supposed to have the right to visit my children, supervised but even after 4 certified letters wanting to set up visitation sent to my x I still have made no progress. I also took a lie detector test and passed it proving my x-wife's accusations false in regard to molesting my children. Is my case too hopeless to persue? It seems like i'd be throwing money away and I'd only be getting 4 hours a month. Thank you for your great web sight, the information is excellent. tennisboy37

Your long absence from your children does not speak well for you. I get the impression that this absence is and has been caused by your ex-wife's allegations against you. The polygraph will help and you must show a total lack of any other offenses regarding children and morals or sex charges. Do you have a parenting plan currently in effect? What does it say specifically about visitation and increasing visitation?
This will be a hard battle but it is not impossible to make progress. If I could secure visitation for a man who, in the middle of his divorce, decided to undergo a sex change operation, then your case is not hopeless at all. As to expense, you are looking at between $7,500 and $12,000 in fees and costs to get this situation straightened out. That may seem like a lot of money but you have some serious and substantial obstacles to overcome. Your initial retainer with me would be a minimum of $7,500 before I could start on your case.
