Home ownership divison

We agreed to temporary separation. It has been four months.

She's still in the home, with the children. Time is making the situation more distant and negative. I am concerned about the house, which is in both our names. I am not in a hurry to divorce yet. Should I be concerned about my rights to equitable value divison regarding the house right now? I am still paying the morgage. Or is time working against me?

If you are uncertain whether you want to obtain a divorce, you may wish to obtain a legal separation. As part of a legal separation, property rights and responsibilities can be divided.
