Legal Question in Family Law in Washington

Home ownership when everything is in your name

My wife and I are just starting the separation process in WA State. Our mortgage note is in my name only and the deed of trust is also in my name only as ''a married man as his separate estate'' Who owns the equity in our house? Is she responsible for ant of the debt? If I move out and don't pay the mortgage is she liable for any portion while we are still married?

Re: Home ownership when everything is in your name

You talk about separation, not dissolution of marriage (divorce) and they are different, although they both can have property disposition, and the rules are the same. The simple answer to this question is the property and debt are all yours, but all property and debt is before the court in the dissolution of marriage.
