Husband in Jail, Give paycheck to Wife?

We have a situation that came up last week. One of our workers is in jail, charged with Domestic Violence. He contacted me and told me to NOT give his last paycheck to his wife, that he wants me to hold it until he gets out of jail. His wife is demanding that I turn it over to her. May I legally hold the check per my employee's request, or must I turn it over to his wife? The wife does not have a court order, nor to the best of my knowledge have any divorce proceedings been started.

Based on the facts you have stated, I would say, absent a court order, you should comply with your employees directions on disposition of his paycheck.
