Legal Question in Family Law in Washington

ex husband sex offender and our son

my ex husband is a level one sex offender and was charged with third degree rape of a developmental disabled 22yr old which by her councilor says she has the mentality of an 8-12yr old. he also has a few anti harassment orders in place against him, one from myself. i do have full custody of my son, and he is 6.5 yrs old. his bio father has not seen him for five years and has not followed the parenting plan. now he has showed up at my door saying he wants his son. the most important question i have is, ''Can the courts give him unsupervised visitations with this on his record.''

Re: ex husband sex offender and our son

Yes, unless you do something about it. You should file a petition to modify the parenting plan to allow only for supervised visitation. You will need to get documentation to support your allegations. As you file the petition you should then immediately go to ex parte and get an order restraining your former spouse's contact until there is a hearing.
