Income Tax and Court order

My court order states that if I do not work 32 hours a week for 10 months out of the year, my ex husband can claim both children. I have worked 40 hours a week for 8 months in 2005. In both instances I have worked 1280 hours. Do I have a right to claim one of my children on my taxes?

This is a situation that may be affected by the precise language of the Support Order. It also is probably one of those situations that you would have to get resolved by a court (to be sure of how the order is to be interpreted).
