You should look to how the tax deductions were allocated in the Divorce Decree or in some cases the Order of Support. If there is nothing said about it, the deductions go to the parent with whom the children reside most of the time, although Washington does not call this custody, they concede that for the purpose of some laws there needs to be a person called the custodial parent. To deviate from the custodial parent receiving all tax deductions for children your spouse should sign an IRS Form 8332, this can be done for multiple years. I would recommend that you have the signed 8332 in hand before you file claimimg deductions for the children.
