Legal Question in Family Law in Washington

injury during the divorce process

My wife and i were legally separated in June. In August i was injured at work and have been off

on a workmans comp injury. I had surgery in Oct. The courts so far are refusing to recognize my injury.

I am falling into arrears and have been found in contempt. Can the courts ignore my injury?

Re: injury during the divorce process

Have you moved to modify the order on the basis that your circumstances have changed? Just responding to a contempt charge isn't enough, you have to pro actively petition for a change.

The court isn't ignoring you. They do expect you to tell them about a substantial change of circumstances BEFORE the other party starts griping.

Hope this helps. Elizabeth Powell
