Well there is a loaded question!
The principle is parens patriae, and that means the state (or a province, or possibly a tribe) has a duty and obligation to look after a child if the parent of that child cannot or will not.
People also don't seem to get that when individuals cannot make decisions a judge will make a decision for them. So, it can certainly happen that custody is awarded without "consent".
If you don't get to the same result as the Court then the Court is going to do as it thinks best whether you agree or not.
