Legal Question in Family Law in Washington

International Custody

My son was in Polond for school, he is home now some girl he met over there has emailed him to say she is pregnant and he is the father. She wants money and claims she will get lawyer. My son doesn't believe her and has no interest in a relationship in any case. If she is indeed pregnant and can somehow prove it is his what legal obligation will he be forced to do from another country. How can paternity be proved form 2 people in different countries.

Re: International Custody

I can not speak to Polish law on paternity or how those actions procede. I would expect that because the child will most probably be born in Poland, that is the location for any paternity action. Under the laws of the states of the United States, paternity may be proved by genetic testing (with a few exceptions relating to presumptions about husbands being the father of his wife's children). You may want to preemptively test for paternity; I would suggest asking for double testing (i.e. testing at a Polish lab and at a U.S. lab, e.g. Genelex here in Seattle). If your son is the father then there will be issues of custody and support that will have to be resolved under Polish law. You should consult an attorney licensed to practice in Poland. This is not a matter to see how it turns out before obtaining counsel.
