Next of kin
when the spouse has died, how does the surviving spouse prove that they were married at the time of death?

A marriage certificate is a good start. Depending on what the question about the marriage is, there are sources of information that can be accessed that would verify certain information. E.g. if somebody asserted that the parties had divorced in WA, there are databases that allow one to find dissolutions filed by county. There are also genealogical databases which hold vast amounts of historical data from court records (from all over the world).
