If I were to legally separate from my husband, of one year, what would happen to the debt we currently have. Each of us had debt that we brought in to the marriage and the debt that we aquired together. We are amlicably making joint payments toward paying off the debt. Could we individually apply for a loan to pay off the debt we each had prior to marriage,under our individual social security numbers, and have the court and state of Washington aknowledge this as separate debt and having no credit reflection on either spouse. What are the regulations of legal separation pertaining to debt and sex.

In Washington, as a general rule, debts that are brought into the marriage remain separate, so yes, each of you would be able to obtain a loan to pay off your separate debt and keep the loan separate. This would be different if you were not legally separated, then the loan becomes community.

The community debt that was acquired can be handled in the way you say ... in fact, when both parties work together and agree, things usually go better.
