do i have any legal rights

i desperately need to know if i have any legal avenues at all for me to gain and use the only income that r marriage has ever had right now. my husband has up and walked out on me and i didnt know this nor do i know where he is other than the state it self. i cant even eat.

First you can file for dissolution of marriage, make a motion for temporary orders for spousal maintenance and child support if appropriate, (you will have to get your husband served, if you know where he works you could arrange to have him served there or near there, (after a diligent investigation if you can't find him, you may file a motion to allow service by publication). If you can prove you are without funds you can get a fee waiver (on the filing fee). Many counties also have an office that assists pro se people in family law cases. In the end, if you have followed the rules on service, you can get a default judgment if he does not respond to the summons, and you can get what you petitioned for. Keep in mind that if you should reasonably been able to find him, and you failed to act diligently to effect personal service you may be subject to your decree and orders being vacated and sanctions. Without knowing how long you have been married and whether you have children, I would not want to predict the outcome of a motion for temporary spousal maintenance, child support (if you have children living with you) is assured, the amount is derived from a formula based on number of children and combined incomes (to set the amount of support) and ratios of incomes to set the share each parent is responsible for.
