Legal Question in Family Law in Washington

Legal Seperation and Child Support

I am filing for Legal Seperation from my husband of three years. I don't want to ask for child support, but the Seperation Decree doesn't give me that option to select. I do want to enter a parenting plan and reserve the right to request child support in the future when my or my daughter's needs change.

Re: Legal Seperation and Child Support

Washington requires that an order of child support be entered to provide for the child's needs. You don't have standing to decide that she doesn't need support, it is for her, not for you.

That said, you and your husband can make agreements regarding a deviation from the statutory amount that is required. Sometimes there are perfectly good reasons to request less support - sometimes, no support at all.

You might want to do a brief consult with an attorney who will provide unbundled services and ask them to draft a support order and worksheets based upon your reasoning to achieve the results you want.

Hope this helps. Powell
