Living accomodations in divorce proceedings

I want to divorce my husband and he basically agrees with this. I would like him to move out of our home. I have asked him to and he has refused. He is currently unemployed and has not worked for the past year. He is a professionally employed person when he has a job.

He cannot afford to pay the mortgage on the house and I can and do. I could move out but I cannot afford to continue to pay the mortage and rent another place to live. I don't think it is wise to lose the house and equity that we have in it if I leave. My question is what are my rights in this situation? I think if forced, he could manage to get some kind of temp. job and rent himself a place to live. He is not disabled in any way.

You would file your petition for dissolution and ask, in a motion for ex-parte restraining order or motion for temporary orders that he be restrained from returning to the home.
