modification

My sons father and I had an agreed parenting plan where he had him everyother weekend during the court process I signed a form saying that we would alternate years on claiming our son on income tax, my son now lives with me and my husband except one weekend every other month due to moving and I would like to change it so I claim him every year and his father does not due to our son being with us more then half the year is this possible how would i do that I dont know what the form was i would have to find it in the file, his father ( we were never married) has only claimed him once and I signed a form for the IRS stating I would not claim our son that year. Is there anyway to rectify this?

Re: modification

Your parenting plan would not address income tax deductions. That would be in your order of support. To modify the support order you would have to file a motion for modification of the support order. If you want to modify the parenting plan at the same time you can do both through a petition for modification of the parenting plan. My practice includes Pierce County.
