Legal Question in Family Law in Washington
Mom wants to move away with my daughter
My daughters Mother MAY be attempting to
buy a house with her new husband and move
away with my daughter to another city. (I
got this news from my six year old
daughter who overheard her Mom and Step
dad talking about this). She (the mother)
is the ''custodial'' parent but I am the
''lawfully'' recognized father and I am very
involved in raising my daughter. We do
have a legal parenting plan but I feel
that this move away will greatly
(negatively) effect my relationship with
my daughter as well as disrupt her
schooling, friendships etc... Is there
anything I can do to stop this move by her
Mother, or should I simply wait for her to
give me some kind of notification of her
intent to move?

Re: Mom wants to move away with my daughter
I would start by sending a letter to the ex, asking if it is her intent to relocate. If she doesn't answer...fine...a lack of communication on her part is good evidence. Keep a copy of the letter. The new relocation statute requires the primary residential parent to give 60-days notice of an intent to relocate (There are exceptions to the 60-day-notice provision, which do not appear to apply.) Gather all information you can, and if she relocates without notice, get a lawyer.
