motion for modification child support
Ex husband just got out of prison was divorced while he was in prison due to circumstances child support set at $25 he has a job now good income, he has over $30,000 in debt for criminal lawyer, he has a lien on my house threw the divorce. I have low income job, I have house with alot of equity I also have substantial amount of money in savings account. I want to put in a motion for modification of child support.What effect does the fact that he is in considerable debt and I have assests have on a modification or is it based more on his income? He has no visitation with the child there is a permanent no contact order against him.

Even if he has debts, child support will take priority over them. An adjustment based on change of circumstances is appropriate.
