moving with child to another state
In my court orders i recieved when i went to court for child support for my son; it read that if i was to ever move out of WA i needed to let all parties involved know and if they wanted to appeal it they could. My sons father just told me that i needed to let the court know i was moving and then when he says he doesnt want me to take his son to OR i wont be allowed to move. Im not sure where to start. who do i talk to make sure i am in the right to move with out his fathers premission. i have let all parties know. no one in the court system will tell me anything b/c they say that is giving legal advice. i am to read it and interperet the order as i see it. My support officer said to contact an attorney and ask them to clarify what my steps are that i need to take. i will moving very shortly so if i could recieve an answer soon i woudl appreciate it. thanks so much!

An Order of Support usually requires you to report a change of address when you move, but the provisions on relocation apply only to moving the child's primary residence and that is found in the Parenting Plan or Residential Schedule and only affects the primary residential parent. There is a specific process for effecting notification and change of location. There are eleven factors that the court considers in determining whether to allow the move. I can't speak to whether the court will allow you to relocate the child but your failure to provide the appropriate notice may result in your having to return the child to Washington pending resolution of the matter.
