Legal Question in Family Law in Washington

Moving with children after divorce

I am in Fort Drum, NY. My fiancee is in Seattle. Next month I will be flying there for our wedding during block leave. I just returned from Afghanistan.

My Fiancee is divorced and has a 5 year old from her ex husband. He says he wont let her move to Drum with me, but she says there is nothing in their paperwork stating he has any custody of the child.

What can I do to live with my future wife?

Re: Moving with children after divorce

Your fiancee has a parenting plan. If it is a WA plan, it includes language about her duties as the custodial parent to give formal notice before relocating the child out of the school district for any reason.

She should read her parenting plan. She should go to www courts dot wa gov and look at the forms for the relocation statute.

You can live with your future wife, don't fear - the question is whether she (and you) get to retain custody of her child.

Hope this helps. Elizabeth Powell
