Moving out of state

I've had custody of my son for nine years now and would like to move to Hawaii. I have family there an the oppurtunity to work into ownership of my parents' business of 15 years. My ex-husband will not agree to this. He visits our son every other week-end. I have offered Summer,Winter, and Spring visitation and to pay half of transportation costs. I've also agreed to allow our son to visit in the event of a family emergency or special event. Finally, I've agreed to keep child support as it is now, currently 1/2 of the standard and never been modified.

Can he prevent me from this move?

If you are living in Washington we have a new law that probably applies to you. You are required to give him notice of your intent to move. He is then required to object to your move. If he objects, a hearing is then set to see if you get to move right away. If you are not allowed to move right away, the court will usually appoint a parenting investigator to do a report and make recommendations. A final hearing is then held. The law is new and the judges have different ideas about what it means so the outcome is unpredictable. You can look at RCW 26.09.405 for more details.
