Legal Question in Family Law in Washington
Moving out of state w/kids, new spouse in military
My husband is in the Army. For the time being, he is stationed in Washington. My ex has made it very clear that he would fight to keep the kids here (nothing in the divorce/parenting plan paperwork prohibiting me from doing so-just that he has the right to object). If he does fight, what are the chances that a judge would take his side and make the kids stay here? My ex and I have joint custody, me being custodial parent. I have every intention of revising the parenting plan to make it as fair as possible, down to splitting the airfare with him. And I don't know if it would be against him that he plead guilty to assault in the 4th degree against me (though he did take his alcohol tx and anger mgmt classes). I just afraid that my kids and I will be forced to stay here.

I don't have enough information to answer you. Was th edivorce final in Washington? Or another state? In Washington, there is the child relocation act to worry about. Get back to me about the facts of your case so that I can give you a better idea of what the situation is.
