Non parental Custody

Just got a notice in mail that stepchild who lives with other parent is now living with one of the parent's adult ''friend''. We have never been contacted and have no knowledge of why this is occuring. All we know is child support thru state now says $ going to someone else because they have physical custody. The court file shows no activity in over a year. Shouldnt there be some knd of modification filed? shouldnt we have been served with some docs?

How does this happen? We'd heard there was some criminal activity with other parent but thought it was resolved. if other parent is incarcerated, wouldnt child go to the non custodial parent automatically?

This question is unclear. You should organize your thoughts and the relevant facts more clearly. I can answer some parts of the question, but If one parent was in jail the other would normally, but not always or automatically get the child.
