Legal Question in Family Law in Washington
Noncontested divorce turns Contested!
My Wife and i are divorcing, selling our home. we agreed on division of proceeds from sale of home, all household items and other community belongings. We documented on petition and signed and filed. I/we didn't document our intentions of division of 2006 joint fed. income tax return but we did agree verbally to split 50/50. We E-filed. Deposited in account at bank. i had no access to account. She finds out that i've been with other woman freaksout and havent heard from her again. I havent received my belongings that we agreed upon in writing nor my 50 of return! she will not talk or give me time of day. Is she legally entitled to all of tax return after we had verbal agreement. Also, items that are documented can she keep them? I know i need representation. I also need to know what i'm looking at as far as a battle in court. Do i have a case or does she or will she be awarded all? Help!

It happens. What this is going to take to fix it depends on where you are in the proceedings. If the written agreements have been signed by both parties they are enforceable, so you will get your stuff, and it is possible that the division of the tax return can be inferred from the other division.
No, she is skating on thin ice by taking the tax return and your property.
it doesn't have to be a battle, but a lawyer is probably going to have to straignten this out.

Nobody "wins" a divorce, especially not by refusing to contact the other party and just taking everything.
Hope this helps. Powell
