Legal Question in Family Law in Washington

Non-custodial parent not abiding by parenting plan

My ex-husband is not abiding by the parenting plan, by calling at the last minute to ask if he can keep the child longer. What are my legal rights to ensure the plan is followed?

Re: Non-custodial parent not abiding by parenting plan

Your first step is to discuss the ex's inappropriate behavior out of the presence and earshot of your child(ren). You should also write a letter telling him that you expect him to comply with the parenting plan's time tables for return of the child(ren) and that for the exception of unforeseen calamities or emergencies, no delays will be tolerated. If that fails, you will have to resort to your dispute resolution provisions in the parenting plan. And if that fails to cure the problem, then you willhave to resort to court action and bring a motion for contempt. Any more questions? Please contact me via telephone.
