Legal Question in Family Law in Washington

Non-parental custody case

I am the mother of a 5 year old little boy. I am being fought for custody of my son by some old friends of mine that used to be his babysitters. What is the name of the Washington State law that states that in a non-parental custody case it is the petitioners burden to prove the mother unfit?

Re: Non-parental custody case

The law that controls is called Nonparental Actions for Child Custody and is found under RCW 26.10.010 and subsections that follow. The standard is not whether the parent is unfit, the standard is best interest of the child. You should consult with an attorney.
