I wasn't even notified of the court date!
We separated and filed for divorce. He would keep the girls and the house and our parent plan was worked out. Two weeks shy of the court date we got back together. I was told the divorce was canceled. Ten months later nothing has changed for us and I want out for good this time. He re-files on Monday, we're divorced 10 days later and I didn't have a clue! I wanted to change the rules from the first separation but didn't know it was still filed. I wasn't even told about the court hearing. Is this legal? Can I have changes made to the divorce that affect my rights to the home and the girls? This was so underhanded as far as I'm concerned. He hired the attorney to represent both of us but it sounds like it was his attorney! Now he is even trying to take the girls permanently saying I left the marriage because I didn't want to be a mom. I just didn't want to be his wife. Help I need advice.

It all depends upon what papers you signed when the original divorce action took place. You need to get your own attorney NOW and take IMMEDIATE action. If in fact there was an attorney who was representing you both, then all he could do was process the paperwork. But, he would have to keep you informed of all actions. This matter is far too complicated to answer here. See a lawyer without delay because if you delay too long, it can look like you agree with what happened.
