Obtaining Grandparent custody from CPS
My husband and I raised our grandson, now 2, from birth.. Our new grandson, who is 6 weeks old we saw born and lived with us too.
The parents moved out (had lived with us off and on). Within 4 weeks were back to meth use, dirty house, violence. We have a paper trail with law enforcment and a CPS complaint against them. We did all in our authority to protect those children.
CPS took the babies 8 days ago. Shelter care hearing was last week.
CPS is considering us for placement. Apparently we have to clear with a criminal history, home inspection and who knows what else.
Questions:
Why couldn't the children have been placed back with us immediately?
The parents get 2 hrs. twice a week to see the babies, but what about us?
Why can't this happen faster? The children need to be with us, we are their family!
Can my husbands convictions 4 years ago of a physical control and gun possession be held against us? Our attorney on the lawsuit for that incident will explain. I have given that attorney's name and number to the SW..
We do not drink alcohol, no other criminal background. We are Christian, attend Seventh Day Adventist church and my husband works every day at a job he's been at for 6 years.

Unfortunately, CPS has the power to remove the children until the investigation is complete. In order to avoid this in the future you could petition the Superior Court in your county for third party custody of the children. This will make you and your husband the permanent custodians of the children.
