Legal Question in Family Law in Washington
overtime
my wife and i are legally separated.
right now i am paying what is equal
to forty hours a week of my labor just to pay her. This seems very unfair.
Is there any case law about overtime or over burdening of the respondent?

Yes, there is a lot of caselaw on the basis for an award of maintenance/child support and the equitabble division of assets (property and income). There is a limit to how much of your income can be taken by another party.
However, the fact that there is a court order tells me this has been adjudicated. If circumstances have changed since the order was entered it may be possible to have the order modified.
It also depends on what the judge thought about the case when he or she heard it. You may well be being punished for some transgression (no, I can't tell what) like hiding assets. But I can't tell on these facts.
If you don't have your own lawyer this would be a good time to go get one.
Hope this helps. Elizabeth Powell
