Parenting Plan Language

I'm looking for language that

basically states what happens

when either parent is hospitalized

for more that 24 hours. Example:

my ex was admitted to a detox

center for a week while her

enabler, attorney friend (now

husband) kept it from me and

enlisted my 2 children in keeping

the ''secret''. We have a joint,

shared 50/50 parenting plan. I felt

the children belonged with me until

their mother was able to care for

them. Mr. attorney felt they should

stay with him. Sheriff's deputy said

''it needs to be spelled out in the

parenting plan'' for me to go get

them. I think the language should

mandate they be transported to

the other parent (we live in the

same town).

Is there a good paragraph or two

you can suggest that I can use to

add this functionality to my

parenting plan?

Something like this:

In the event that a parent is unable to exercise scheduled residential time he/she must notify the other parent at the earliest opportunity. Notice must be provided in writing or direct phone contact. If the child is to be placed in child care for a period in excess of 4 consecutive hours the other parent shall be notified and offered the opportunity to have additional residential time during that period. Time spent with a step parent or other family member, not a parent, and in the absence of a parent of the child is considered child care for purposes of this provision only.
