Parenting plan
I no longer work during the day. Ex and i have joint custody. I want to provide the daycare while he is at work. he wants his girlfriend to watch our son, I think I should especially on his early release day. I want to do a minor modification. We are 1 mile apart. It would not change joint custody 50/50 overnights.

I don't know what provisions relating to daycare you have in your parenting plan. Either approach has some merit, but typically parents have the first claim on time with the child. I've never litigated a case on this issue, and in an effort to avoid litigating them, I often put in parenting plans that the non-residential parent shall be notified of any time the residential parent would have to utilize child care and that the non-residential parent has the right to that time. I also typically put in the parenting plan that the residential parent shall spend as much time with the child as is practical taking into consideration, the social and developmental needs and interests of the child.
