Parenting Plan Violation

My daughter's father was arrested on domestic violence charges and deported, illegal alien from mexico, from the country 5 weeks ago. A parenting plan has been in place since 2003. I have been informed that he will not be attempting to return to the country for a year, and am unsure if he will even be able to get back then. He will not be paying child suport or having visitation, verbal or phsyical during the time he is gone. I need to know what legal action I can take to get his visitation rights taken away and whether or not he would be able to re-apply for visitation if he is able to return.

Ideally, I would like to have his parental rights taken away and have my husband adopt her. We have no phone number or address in mexico where he can be located and there has been no attempt to contact us. We need to know how we can proceed with removing visitation or proceeding with adoption if there is no means to contact him, serve him with legal documents, or have him appear while he is out of the country.

You will need to contact an attorney who handles adoption. You may be able to have notice published or to have someone locate him in Mexico. An attorney could determine the best course of action.
