paternal tests

If couple have filed for divorce but are still married and she has a baby with another man but claims the baby is her husbands. Is there any free testing done that will hold up in court to prove diff?

I don't know of any free genetic testing services. Most of the services that do it charge about $500 for collection of samples, testing, and reporting. If this is important to you, and I can't imagine if your asking the questioni that it is not, then it is is too important an issue to not have handled professionally.

There is a whole section of the Parentage Act devoted to how this situation is handled.

There is a presumption that the husband of a married woman is the father of her child. If the real (bio) father is not formally served and told he will be paying support and the presumed father fails to bring an action denying parentage within TWO years, then the husband is presumed the father.

But - it is going to cost you money to get the testing done. This is not the place in life to save money. Get an attorney, and have the testing done (if any) professionally by an approved laboratory.
