paternity question

If paternity was never estabished, and the father and mother were never married, how do I go about completing a step parent adoption if I haven't even heard from the father in 9 years? The father is not in this country legally.

The father's immigration status is not relevant. The first thing you need to do is terminate the relationship of the alleged father. You need to file a petition and get him served in compliance with Rule 4. (Ideally you would get him to respond by voluntarily consenting to the termination and adoption). Then after the parental relationship is terminated, the adoption is just like any other adoption, and you just follow the laws and rules for adoption.
