not paying support then what rights does he have?

my ex-husband hasn't paid support since june 2002,and hasn't helped with daycare at all.we have a parenting plan agreement. Do i have to allow him visitation since he hasn;t paid. I don't know what to do?I have contacted my attorney, but i never seem to receive a phone call back.

Although your former spouse is not paying the child support ordered, you may not withhold visitation from him. You still must comply with the Parenting Plan.

The converse is true as well. If one parent is not in compliance with the parenting plan, the other parent may not withhold child support.

However, you may seek to enforce the child support order. For example, it is possible that you could obtain an order that would allow garnishment of his wages to pay the child support.
