Re: proof of income

What you need to do is file a petition for modification of child support and then ask for what is known as "discovery". Discovery allows you to have not only access to his paystubs but also his bank statements (if you subpoena them) and this may show that his deposits far exceed the income he claims.

If you can't afford an attorney try speaking to the clerk of the court in your jurisdiction. Although they cannot give legal advice they will often help you with regard to the forms. Tell them you need to prove his income and you believe he is making much more. If you did have an attorney you could subpoena many financial documents. Did he recently finance a car, a house? That is the evidence you are looking for!

Good luck to you. If I can help give me a call at 703-968-3974.
