Property division

I have a condominium in separate property (aquired before the marriage).

If the condominium is sold before the divorce, is the increase in price of the property during the period of the marriage dividable?

The short answer to your question is no. Unless, you used community assets to improve the property, or your spouse helped in improving the property, any profits from seperate property stay seperate.

Generally property's character as separate property does not change, unless your spouse made a contribution to the improvement of the property (money or work) or making payments on the property. If the money from the sale is moved into an account avoiding commingling with community funds the money and assets purchased later can continue to be accounted for as separate property.
